I sitt beslut fann Linda Friberger att s\u00e5 skulle vara fallet. Hennes beslut \u00f6verklagades dock till tingsr\u00e4tten som gjorde motsatt bed\u00f6mning. Hovr\u00e4tten f\u00f6r V\u00e4stra Sverige fastst\u00e4llde sedermera tingsr\u00e4ttens dom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I likhet med advokat Linda Friberger, och i motsats till tingsr\u00e4tten och hovr\u00e4tten, konstaterar nu H\u00f6gsta domstolen i sin dom att det \u00e4r tydligt att en bostadsr\u00e4tt \u00e4r en annan typ av egendom \u00e4n en hyresr\u00e4tt, att en ombildning av en hyresr\u00e4tt som skett under samboendet \u00e4r fr\u00e5ga om ett f\u00f6rv\u00e4rv i sambolagens mening samt att ett annat syns\u00e4tt skulle vara sv\u00e5rt att f\u00f6rena med lagstiftningens \u00f6vergripande syfte.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Du kan l\u00e4sa avg\u00f6randet, som kallas \u201dSambons ombildade bostad\u201d, <a href=\"https:\/\/www.domstol.se\/hogsta-domstolen\/avgoranden\/2022\/113241\/\">h\u00e4r<\/a>.<\/p>","protected":false},"excerpt":{"rendered":"<p>G\u00f6teborgs tingsr\u00e4tt f\u00f6rordnade Linda Friberger att f\u00f6rr\u00e4tta bodelning mellan tv\u00e5 sambor.
